The makers of the popular Grand Theft Auto series are being sued over the sexual content present in their project.

Rockstar, a subsidiary of Take Two have been sued by Los Angeles City Attorney Rocky Delgadillo on the basis of the hidden sexual content present in their 2004 hit title, Grand Theft Auto San Andreas . The attorney has reportedy filed the suit against both Rockstar as well as Take Two Interactive for allegedly making misleading marketing statements contradicting with the state's laws. Delgadillo has also brought the case to court on the grounds of the company engaging in unfair competition.
The Los Angeles Attorney claims that Rockstar mislead the public of California through not disclosing the adult content present to the Entertainment Software Ratings Board, violating a state law in the process. The 2004 title had previously been rated "M" for mature audiences only. The Attorney feels that disclosing the sexual content present within the title would have resulted in the ESRB rating the title a much harsher "AO" or for Adults Only.
For those unfamiliar, the sexual content discussed regarding the hit title comes in the form of a downloadable mod known infamously as "Hot Coffee", resulting in a sexually explicit scene portrayed by the game.
"Greed and deception are part of the 'Grand Theft Auto: San Andreas' story — and in that respect its publishers are not much different from the characters in their story. Businesses have an obligation to truthfully disclose the content of their products — whether in the food we eat or the entertainment we consume," said Delgadillo.
